Step 1: Original Petition - Submitted by the U.S. Fiance(e)
- U.S. Fiancé(e) sends petition to the USCIS Service Center for their state.
- U.S. Fiancé(e) receives approval or denial notice letter in the mail.
- USCIS will forward approval and documents to the consulate in Canada (Montreal or Vancouver)
Step 2: Consulate Interview
- Consulate sends forms and instructions to the Canadian fiancé(e).
- Canadian fiancé(e) gathers the required items, and sends the Affidavit of Support (I-134)
to the U.S. fiancé(e).
- After ALL required items have been obtained, and the U.S. fiancé(e) returns the Notarized
I-134, the Canadian fiancé(e) sends the checklist back to U.S. Consulate.
- Consulate will respond with a letter stating an interview date and further instructions.
- Canadian fiancé(e) goes to the interview, and if approved, gets the Visa in his/her passport and can travel to the U.S. to marry the fiancé(e). K-1 Visa is good for ONE entry into the U.S. and has to be done within a 6 months from the date of issue.
Step 3: AOS (Interview 2)
- Canadian fiancé(e) goes to the U.S. boarder and tells the boarder inspector that he/she is entering on a K-1 Visa. They will need to see your passport and ID so have them handy. They may also need to see the letter that is attached to the "mysterious envelope" that you were given at the Consulate after your interview. Make sure you have the sealed envelope and ALL the papers and documents in order because you'll need to give it to them when you go in and also $6 USD cash for the processing fee.
- Canadian fiancé(e) enters the U.S. and then has 90 days to marry the U.S. fiancé(e).
- Get married and complete AOS documents.
- Adjustment of Status (AOS) is filed at nearest USCIS field office. The interview may be the same day or you will be given an appointment date.
Step 4: Removal of Conditions
- Petition to remove conditions is filed in a 90 day period before the 2nd anniversary of becoming a permanent resident.
